Heard learned counsel for the petitioner and learned Standing counsel.
The petitioner has preferred this writ petition so as to quash order dated 10.10.2018 passed by respondent no. 2 Secretary, Regional Transport Authority, Mirzapur cancelling permit/license No. UP63/GC/2018/233 which was valid till 11.02.2023 in connection with Truck No. UP-63-AT-1283.
The petitioner has submitted representation to the Regional Officer requesting to withdraw the cancellation of the above permit/license.
The order cancelling the permit/license is appellable under Section 89 of the Motor Vehicles Act, 1988. Therefore, resorting to the remedy of the representation to the same authority is of no purpose.
Accordingly, instead of directing the authority to consider and decide the representation of the petitioner, we dispose off the writ petition with liberty to the petitioner to appeal against the said order, if he is so aggrieved by the same.
The writ petition is disposed off.
