By means of this petition, the petitioner prays that the Divlorce Petition No.101 of 2011 filed by him be decided expeditiously within stipulated period.
The petitioner claims to be married with respondent no.2 in the year 2007. However, the dispute arose between the prties and allegations and counter allegations ensued. The cases under section 498 IPC etc. were filed and for quashing of the same a writ petition before this Court was filed and it is alleged in para 4 of the present writ petition that before a Division Bench of this Court on 25.1.2010, the respondent no.2 made a statement that she does not wish to stay with the petitioner husband. It is also submitted that the parties were sent to Mediation Centre, Allahabad where they failed to arrive at any settlement.
According to the learned counsel for the petitioner since respondent no.2 has made a statement before this Court that she does not wish to stay with the petitioner, the decree of divorce be granted in his favour.
Be that as it may, the writ petition is disposed of with the observations that the court below would decide the aforesaid suit in accordance with law without granting unnecessary adjournment to either of the parties.
