JUDGMENT / ORDER

Hon'ble Manish Mathur,J.
The case is taken up through Video Conferencing.
Heard learned counsel for petitioner(s) as well as learned AGA for the State.
This writ petition has been filed challenging FIR registered at case Crime No. 244/2021, under Sections 147, 148, 149, 323, 324, 427, 457, 504, 506, 395, 397 I.P.C. and Section 7 Criminal Law Amendment Act, Police Station Atrauli, District Hardoi.
After arguing the matter at some length, learned counsel for the petitioner(s) states that he may be permitted to withdraw this writ petition with liberty to the petitioner(s) to take recourse to the remedy available under Section 438 Cr.P.C.
Accordingly, the writ petition is disposed of with aforesaid liberty.
However, it is directed that in case the petitioner(s) approach(es) the court of competent jurisdiction by way of moving appropriate application under Section 438 Cr.P.C., the same shall be considered and decided in accordance with law, with expedition.
