Heard learned counsel for the petitioners and learned Government Pleader for Revenue By representation dated 05.07.2013 addressed to respondent No.3- Tahsildar, Chandragonda Mandal, Khammam District, the petitioners have sought survey of the land admeasuring Ac.11.31 cents in Sy.No.91 of Damacherla Village, Chandragonda Mandal, Khammam District. The petitioners’ claim that they are the protected tenants of the said land and they have been issued ownership certificate also in that capacity. They, however, claim that due to boundary dispute, they approached respondent No.3 and requested for survey of the said land. Alleging inaction on the part of respondent No.3, the present writ petition is filed.
Learned Government Pleader for Revenue, who has taken time to get instructions, submits that the petitioners have not remitted fee through Mee-seva or in-person, as such, if the petitioners apply in conformity with the prescribed proforma, appropriate steps will be taken by respondent No.3.
In the circumstances, the Writ Petition is disposed of permitting the petitioners to make an appropriate application as per prescribed proforma by paying requisite fee in accordance with relevant Rules and, if such application is filed, respondent No.3 shall consider the request of the petitioners for demarcation and survey and act in accordance with law, within a period of two months from the date of receipt of application of petitioner. There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
