Sanghi vs Assessee

1. Assessee has filed this appeal calling in question order of the Tribunal which insists on the appellant depositing 50% of the duty amount to enable the appellant to press its appeal before the Tribunal on merits.

2. Issue notice to the respondent returnable on 11th October, 2012. Direct Service permitted. Considering the issues involved, we may take up the appeal for final disposal at the admission stage itself.

3. Till further orders, the Tribunal is requested not to proceed with the pending appeal of the appellant.
