Learned counsel for the petitioner says that writ petition on behalf of petitioner no. 2 Smt. Poonam be dismissed as not pressed with liberty to file afresh.
This petition may be confined with relief in respect of petitioner no. 1.
Prayer made for, is allowed.
Writ petition is dismissed in respect of petitioner no. 2, if so advised.
Petitioner is working as Auxiliary Nurse Midwife in Primary Health Centre Deoria and she is resident of Mau, where her husband and her mother-in-law are residing. On account of illness /ailment of her mother-in-law who is quite old, she moved application before Chief Medical Officer, Deoria that her case may be sympathetically considered and because of hardship on account of ailment of her mother-in-law she may be transferred to district Mau, so that she may look after her mother-in-law and also discharge official duty at the same time.
Chief Medical Officer, Deoria has forwarded his recommendation to be considered by the Director General Family Welfare, U.P. Lucknow for transfer of the petitioner from district Deoria to district Mau on 14.8.2018. However, learned counsel for the petitioner states that her representation for sympathetic consideration for her transfer from Deoria to Mau has not been considered till date.
In the special facts and circumstances of the present case, I hereby direct the 2nd respondent to take appropriate decision in the matter of request being made by the petitioner for transfer from Deoria to Mau particularly in the light of the recommendations made by the Chief Medical Officer, Deoria , if otherwise there is no legal impediment. The decision shall be taken by the 2nd respondent within period of six weeks from the date of production of certified copy of this order in accordance with law.
With the above observations and directions, the writ petition is disposed of.
