This is second bail application moved on behalf of applicant Smt. Sangeeta, the first bail application having been rejected by this Court on 9.9.2016.
The only submission made by counsel for the applicant is that after rejection of the earlier bail, the trial has not been concluded.
Heard learned AGA and perused the record.
Perusal of earlier bail rejection order passed by this Court indicates that the prime reason for rejecting the bail was that the trial had already commenced and it was not found safe to give findings on the facts because it was likely to prejudice the outcome of trial. The situation remains the same. In any view of the matter the facts and circumstances are enough to make out a prima facie case against the accused and this Court does not see it to be a fit case to release the applicant on bail on the merits of the case. This Court does not find it proper to enter into further details causing prejudice to the trial of the case. It is for the trial Court to look into the merits and adjudicate upon the guilt and innocence of the accused.
Therefore, the prayer for bail of the applicant is rejected.
However, it is expected that the trial court shall make all sincere endeavours to expedite the proceedings of the trial and conclude the same as expeditiously as possible without granting unnecessary adjournment to either party.
