Heard Sri M.R. Maurya, learned counsel for the petitioners, Sri Pawan Shukla, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed with the prayer to quash the F.I.R. dated 20.7.2017, registered as Case Crime No.137 of 2017, u/s 420, 467, 468, 471, 386, 120-B IPC, P.S. Ramraj, district Muzaffarnagar.
Learned counsel for the petitioners submits that initially FIR was also lodged by respondent no.3 against the petitioners which was registered as case crime no.251 of 2017. The said FIR was challenged by the petitioner in Criminal Misc. Writ Petition No.10354 of 2018 which was disposed of by this Court on 24.4.2018 and arrest of the petitioners was stayed. This is the second FIR against the petitioners by respondent no.3 who are ladies, hence present FIR lodged against the petitioners be quashed.
Learned A.G.A. opposed the prayer for quashing but could not dispute the aforesaid fact as argued by learned counsel for the petitioners.
The order granting interim injunction in favour of the petitioners in earlier FIR supplied by learned counsel for the petitioners is taken on record.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
