The petitioner, who has instituted a suit against the defendant respondents, has filed the instant petition seeking a direction to the trial court to decide application dated 23.12.2016 Paper No.6C within a time stipulated by this Court. He has also prayed for a direction to the respondents not to alienate or create third party rights in the suit property during the pendency of application for interim injunction.
A perusal of the order sheet reveals that the application for temporary injunction has yet not been disposed of by the trial court. Counsel for the petitioner submitted that Nagar Palika Parishad, which is defendant in the suit, is in a hurry to create third party rights and, therefore, the application for interim injunction deserves to be decided expeditiously.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of by directing the third respondent to make all endeavour to decide the application for temporary injunction expeditiously and preferably within a period of four weeks from the date of production of a certified copy of this order, provided there is no legal impediment.
