This petition is directed against an order of transfer dated 28th June 2019, whereby petitioner has been transferred from Bareilly to Saharanpur. The order of transfer is assailed on the ground that the petitioner is left with only twenty months to retire.
Petition is opposed by learned Standing Counsel.
It is not in issue that petitioner holds a transferable post and transfer is an incidence of service. Petitioner is otherwise continuing at Bareilly since the year 2012 and has completed more than seven years. In such circumstances, no interference with the order of transfer is, therefore, called for.
In the facts and circumstances, it is provided that in case petitioner joins pursuant to the order of transfer, it would be open for her to make a representation against the order of transfer, within a period of two weeks, thereafter and the same shall be dealt with in terms of the transfer policy. Petitioner's future continuance shall remain subject to the fresh order to be passed by the competent authority, as indicated above.
Subject to the aforesaid observations, this writ petition is consigned to records.
