Sri R.K. Maurya, learned A.G.A. has informed the Court that in the present writ petition the relief is only to the following effect:-
"A. Issue a writ, order or direction in the nature of Mandamus commanding the respondents to arrest the accused/Respondent No.4 & 5 in Case Crime No. 844 of 2018, under Sections 376D, 506 I.P.C., Police Station Meja, District Allahabad lodged by the petitioner on 4.12.2018.
B. Issue, a writ, order or direction in the nature of Mandamus commanding the respondents to make the fair investigation in Case Crime No. 844 of 2018, under Sections 376D, 506 I.P.C., Police Station Meja, District Allahabad lodged by the petitioner on 4.12.2018, within specific period as may be fixed by this Hon'ble Court."
It has further been submitted that in pursuance of the order of 8.2.2019 the State has sought instructions and it appears that after investigation the police has submitted a final report as mentioned in paragraph no.6 of the short counter affidavit dated 20.2.2019. Thus, it has been contended by learned A.G.A. that the writ petition has become infructuous and deserves to be dismissed as infructuous.
In view of the aforesaid, the present writ petition is dismissed as infructuous. The petitioner has given liberty to seek such remedy as may be available to him under the provision of Cr.P.C.
