Heard learned counsel for the petitioner and learned Standing Counsel for the State.
The petitioner has purchased a land by a registered sale deed dated 04.06.2020 thereafter the petitioner submitted a petition under Section 34 of the Land Revenue Act for mutation of his name in revenue record before Nayab Tehsildar, Kotwa Tehsil, Padrauna, District Kushinagar which is numbered as Case No.01771 of 2020, Computerized No.T202005440101771 (Smt. Sangeeta Devi vs. Toofani).
The petitioner wants that aforesaid case be decided expeditiously.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.3 to decide the case of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of directing respondent no.3- Nayab Tehsildar, Kotwa Tehsil Padrauna, District Kushinagar to decide the Case No.01771 of 2020, Computerized No.T202005440101771 (Smt. Sangeeta Devi Vs. Toofani) of the petitioner within a period of one year from the date of production of a copy of this order.
The writ petition is disposed of subject to the observations made above.
In view of the fact that due to the pandemic of COVID-19, the certified copy is not being issued by the High Court, therefore, the order downloaded from the website duly certified by learned counsel for the petitioner may be treated as true copy of the order and the Authority may not refuse to comply the order on the ground of non filing of certified copy of the order.
