Heard Mr. Arun Kumar Gupta, learned counsel for the petitioners and Mr. Vrindavan Mishra, learned counsel for respondents 5 and 6.
Having regard to the challenge raised in the writ petition, counsel for respondents-development authority submits that respondents-development authority shall take appropriate steps/action against respondent no.7 within four weeks from today. His submission is recorded and accepted.
In view thereof, we dispose of the writ petition with the observation that respondents-development authority while taking action/further steps against respondent no.7, as prayed for by the petitioners under the provisions of the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010, shall follow the due process of law. It is made clear that this order is passed on the basis of the statement made on behalf of respondents-development authority.
