Heard learned counsel for the petitioner and Shri D.D. Chauhan for the Land Management Committee, respondent no.4.
The facts of the case briefly stated are that an allotment in favour of the petitioner was cancelled in the year 1983.
Against this order, 24 years later, a restoration application was filed, which was dismissed by the Collector holding that there is no logical or cogent explanation for the inordinate delay of 24 years.
This order has been affirmed upon dismissal of the consequential revision file before the Additional Commissioner, Basti Mandal, Basti.
Not only was the restoration application of the petitioner belated by 24 years, even this writ petition, which is directed against the revisional order passed on 16.03.2016, therefore suffers from latches of 3 years.
Upon consideration of the submissions made and upon a perusal of the averments made in the writ petition, I do not find any cogent explanation for this delay of 3 years.
The writ petition is therefore, dismissed on the ground of latches, alone.
