JUDGMENT / ORDER

Heard learned Sr. Counsel Mr. Soparkar appearing with learned advocate Mr. Vaishnav for the petitioner.
In view of the judgment of the Hon'ble Apex Court reported in (2010) 3 SCC 330 and the contentions raised in the petition, NOTICE to the respondents returnable on 8.10.2012. Learned APP Ms. Archana Raval waives service of notice for respondent No.1- State. Respondent No.2 is permitted to be served by D.S. Ad-interim relief in terms of para 18(C) till then.
