The present petition has been filed by the informant seeking direction to the respondents no. 2 to conduct fair investigation pursuant to the first information report dated 21.05.2019 registered as Case Crime no. 214 of 2019, under Sections 147, 148, 323, 504, 506, 427, 347, 386, 354 (B), 452, 395 I.P.C and Section 10 (1) & 22 Uttar Pradesh Regulation of Money Lending Act, 1976., Police Station Daraganj, District Allahabad.
The allegation in the writ petition is that the more than six months have passed but the police has not started the investigation of the matter and the accused persons are threatening the petitioner with dire consequences. In this regard, the petitioner has also submitted an application before the Special CJM, Allahabad on 03.10.2019 but the police is not submitting any progress report in the matter. It is further submitted that the police are acting in collusion with the accused persons and till date no accused has been arrested.
Without expressing any opinion on the merits of the FIR, this writ petition is, therefore, disposed of with a direction to the opposite parties No. 2 and 3 to ensure a fair and proper investigation in the aforesaid First Information Report and conclude the same preferably within a period of six months from the date of production of certified copy of this order.
