Heard learned counsel for the petitioner and perused the record.
Present writ petition has been filed for a direction upon respondent No. 2 to transfer/grant the Fire Arms License of her husband in the name of petitioner, under Chapter III, u/S 13 of the Arms Act, 1959.
Husband of the petitioner was murdered in which an FIR was also lodged. Her husband was having a fire arms license of of 32 bore pistol which is issued on 13 December 2006. After his death, petitioner has moved an application before the District Magistrate on 8 September 2016 for transfer of arms license which is still pending for consideration and no order has yet been passed.
It is the responsibility of the Authority concerned to make necessary arrangements for her security but instead of that no action has been taken. Therefore, the writ petition is disposed of directing respondent No. 2 District Magistrate, Aurriya to decide the application of the petitioner within a period of three months from the date of production of certified copy of this order strictly in accordance with law.
It is made clear that the Court has not adjudicated the case on merits.
