The instant writ petition has been filed seeking a mandamus commanding respondent No. 2 to get the answer books of the petitioner relating to Mathematics, Physics and Chemistry subjects of Ist year B.Sc. examination re-evaluated.
The petitioner claims to have seen her answer books under Right to Information Act, 2005. She has filed the instant writ petition alleging that the evaluation is not proper and grave errors were committed in awarding the marks.
Learned counsel for the respondent University submitted that there is already a procedure prescribed for getting the copies re- evaluated. The said procedure is known as Challenge Evaluation and the petitioner is free to apply. He further points out that the fee prescribed in this regard is Rs. 3000/- per answer book.
Learned counsel for the petitioner states that the petitioner shall apply as per procedure prescribed, but the petitioner apprehends that as a period of one weeks has already elapsed since the petitioner had seen her answer books under Right to Information Act, consequently, the respondent University may decline to carry out evaluation.
Having regard to the facts and circumstances of the instant case, the writ petition is disposed of by permitting the petitioner to seek re-evaluation as per Challenge Evaluation Procedure prescribed by the University by depositing requisite fee and in which event, the University shall carry out re-evaluation of the answer books of the petitioner, without raising objection that the application was not filed within one week.
