Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents no. 1 to 3 and Sri Manoj Kumar Yadav, learned counsel appearing for the respondent no. 4. Sri P.K. Upadhyaya has filed his Vakalatnama on behalf of respondent no. 5, which is taken on record.
Present writ petition has been filed seeking a direction to the respondents no. 2 and 3 to remove the encroachment over Gata no. 328/0.991 belonging to Gaon Sabha land recorded as Navin Parti in revenue record in accordance with law and also to consider and decide the representation filed by the petitioner in accordance with law.
Sri S.K. Upadhyaya, learned Standing counsel has raised a preliminary objection regarding maintainability of the writ petition as the writ petition is not in accordance with law as laid down by Hon'ble Apex Court in petition relating to public interest litigation.
Learned counsel for the petitioner could not dispute the same.
In such view of the matter, this writ petition stands dismissed as not maintainable. No order as to costs.
