Heard Sri V.K. Mishra, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submitted that according to prosecution case earlier the marriage of Anuradha was settled with the applicant but thereafter her marriage was settled with the victim and was scheduled to be held on 10.3.2015 and for taking revenge the applicant had fired at the deceased, who succumbed to his injuries. He next submitted that there is no independent witness of the alleged occurrence. He further submitted that the recovery which has been shown by the police is absolutely false and the same was planted by the police at the behest of persons having ulterior motive. He lastly submitted that applicant is languishing in jail since 4.3.2015 and his trial has not concluded till date, he is entitled to be enlarged on bail.
Per contra learned AGA opposed the prayer for bail and submitted that the applicant is the main accused in the present case who has been assigned the role of firing at the deceased with fire arm and causing serious injuries to him which resulted in his death.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Sandeep involved in Case Crime No. 77 of 2015, under Section 302 I.P.C., P.S. Budhana, district-Muzaffar Nagar Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
