Heard learned counsel for the petitioners and also learned A.GA. appearing for the State.
We have been taken through the allegations contained in the F.I.R. and the material on record.
Sri Sandeep alias Subodh petitioner no. 1 and Smt. Ankita Bhadoria petitioner no. 2 are present, who are identified by their counsel Sri Raj Kumar Mishra. They appear major as per the document and have solemnized marriage out of their own free will.
Notice has been accepted on behalf of respondent Nos. 1 and 2 by the learned A.G.A.
Issue notice to respondent No.3 who may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder Affidavit may thereafter be filed within two weeks.
Steps will be taken within a week.
List this matter after expiry of the aforesaid period.
Till the next date of listing or till submission of the police report whichever is earlier, the arrest of both the petitioners who are involved in Case Crime No.223 of 2012 under sections 363, 366 I. P.C. police station Kotwali District Etawah, shall remain stayed subject to the restraint that the petitioners shall fully cooperate with the investigation and shall appear as and when called upon to assist in the investigation.
