Sri Vivek Dhaka, Advocate has filed his vakalatnama on behalf of the informant, is taken on record.
Heard learned counsel for the applicant, learned counsel for the informant, learned A.G.A. and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No. 200 of 2018, under Section 147, 148, 149, 302, 201, 307, 404, 34 IPC, P.S. Chhaprauli, District Baghpat.
As per prosecution case, the deceased along with wife while returning were ambushed and subjected to firearm injury by the nominated persons; applicant is not named in the F.I.R.; on the same day, F.I.R. was lodged promptly and the complainant in her statement under S. 161 Cr.P.C. recorded on the very same day has stated that the applicant was also present and had caused gunshot fire; body of the deceased was thereafter taken away in a vehicle and disposed of; till date, body of the deceased has not been recovered; incident occurred near a shop of one Pankaj, who in his statement under S. 161 Cr.P.C. assigned the role of firing to Pradeep and others including the applicant; assault weapon has been recovered on the pointing out of the applicant; the vehicle involved in the commission of the crime has been seized and blood stained has also been found therein.
Learned A.G.A. opposed the prayer for bail contending that it will not be in the interest of justice in case applicant is released on bail.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application at this stage.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
