on the case being taken up for hearing Shri Vikas Rana, learned counsel for the applicants and Shri Manoj Kumar Srivastava, learned counsel for opposite party no. 2 are present.
Learned counsel for both parties submitted that parties have amicably settled their dispute out of court by way of compromise and a written compromise filed in this regard has been verified by the Court below. They further submitted that since in view of compromise arrived at between the parties, opposite party no. 2 does not wish to continue the proceedings of criminal case any further, the same may be quashed.
Report dated 23.12.2017 of C.J.M., Bareilly has been received and it reads that pursuant to order dated 08.11.2017 and 15.12.2017 of this Court, parties appeared before her and got the compromise verified. A copy of verified compromise has also been annexed alongwith report.
Since both parties have amicably settled their dispute by way of compromise and as per compromise opposite party no. 2 does not wish to continue proceedings of criminal case any further, allowing proceedings would be nothing but waste of time of Court.
In the result, application is liable to be allowed.
Accordingly, application is allowed, proceedings of case no. 4883 of 2014 (State vs. Sandeep Pathak and others), arising out of case crime no. 30 of 2013, under section 498A, 323, 506 I.P.C. and 3/4 D.P. Act, P.S. Mahila Tahana, District Bareilly, pending in the court of A.C.J.M.-I, Bareilly are hereby quashed.
