Heard learned counsel for the petitioner and Sri Gyan Prakash, learned ASGI appearing on behalf of respondents.
One of the grounds which has been taken by the respondents while passing the impugned order that the petitioner had not appended a certified copy of the order of the High Court along with his representation. It is not disputed by Sri Gyan Prakash, the learned ASGI that the respondents were party to the writ petition and the petition had come to be disposed of after noticing the contentions of the respondents. The objection therefore in refusing to entertain the representation merely on the ground that a certified copy of the order was not enclosed would not sustain.
Faced with this situation, Sri Gyan Prakash states that the concerned respondents shall now evaluate the representation of the petitioner on merits and pass a reasoned order dealing with the claim of the petitioner and communicate the same to the petitioner within one month from today. The statement so made is recorded and accepted.
The writ petition shall stand disposed of. The order impugned herein consequently renders ineffective.
