Petitioner had applied for appointment to the post of Constable pursuant to the recruitment exercise initiated in the year 2015. He has claimed status of an OBC candidate on the basis of a caste certificate issued on 3.2.2014. This certificate is not found to be in terms of the advertisement, as per which the caste certificate for grant of OBC status had to be issued between 1st April, 2015 onwards till the last date of making of application, which was 17.2.2016. The certificate is otherwise not liable to be entertained, in view of the law laid down by the Lager Bench of this Court in Gaurav Sharma Vs. State of U.P. and Others, reported in (FB) 2017 (5) ADJ 494.
In such view of the matter, no direction can be issued in favour of the petitioner. Petitioner has otherwise not scored marks above the cut off in the unreserved category.
Writ petition, accordingly, is dismissed.
