Heard learned counsel for the petitioner and Sri Vikas Budhwar learned counsel on behalf of the respondents.
The present petition is directed against the advertisement dated 23.6.2021 which has been issued for allotment of the site-in- question for setting up the distributorship of L.P.G.
The admitted fact of the matter that the distributorship of the petitioner has been terminated vide order dated 11.9.2020. The order of termination is subject matter of challenge in the pending Writ C no.16649 of 2020(Sandeep Kumar and another vs Chairman and M.D.HPCL and others).
The challenge to the advertisement is based on the assertions that during the pendency of the writ petition challenging the termination order, it was not open for the corporation to notify the site-in-question for setting up distributorship of L.P.G.
In our considered opinion, the issue raised herein can be considered if raised in the pending writ petition, in as much as there is no interim order in the pending writ petition and the relief can be granted to the petitioner in the said writ petition only. The present writ petition is, therefore, found not maintainable.
It is open for the petitioner to amend the pending writ petition for seeking appropriate relief.
The writ petition is, accordingly, dismissed.
