Heard Sri Neelabh Srivastava, learned counsel for the petitioners and learned AGA for the State of U.P.
The writ petition has been filed for quashing the FIR dated 29.6.2018 registered as Case Crime No. 0631 of 2018, under Section 419, 420, 467, 468, 471 & 120-B IPC, PS- Lanka, District- Varanasi.
The learned counsel for the petitioner submits that company of the informant is engaged in business of development of multi- stories building and he used to sell the flats to buyers. The employee of the company namely Ajeet Kumar Agarwal impersonating himself as Managing Director, has executed a sale deed in favour of the petitioners on various dates.
It is further contended that the petitioners are bona fide transferee for valuable consideration and have not committed any fraud.
In the facts of the case, this writ petition is disposed of with a direction that petitioners shall not be arrested in Case Crime No. 0631 of 2018, under Section 419, 420, 467, 468, 471 & 120B IPC, PS- Lanka, District- Varanasi till the submission of police report under Section 173(2) Cr.P.C. The petitioners shall cooperate with the police during investigation.
