The grievance of the petitioner is that on account of his transfer on personal request the petitioner has got the posting over a position, a step lower in rank and accordingly, the pay got reduced. This has happened on account of the fact that in the district where the petitioner got transferred the teachers of his batch were still not promoted and so the petitioner could not get the position. This Court in Writ Petitions Nos. 62893 of 2017 and 23797 of 2018 has already directed the authorities to look into the grievances regarding pay protection of such teachers who have accepted the position lower in rank.
Learned counsel for the petitioner has drawn attention of the Court to the letter dated 13.8.2018 issued by the Secretary, Basic Siksha Parishad to the District Basic Education Officer, Aauraiya to ensure compliance of the order of High Court passed in Writ-A No. 62893 of 2017.
Sri S.K. Pandey, learned counsel for the respondent does not dispute that the controversy in the present case is identical to the one involved in those petition referred to hereinabove.
In view of the above, the District Basic Education Officer, Aauriaya is directed to take decision in the matter and pass appropriate orders within a period of six weeks from the date of production of certified copy of this order.
The writ petition is disposed of.
