Heard counsel for the petitioners and Shri Pankaj K. Govil, learned counsel appearing on behalf of respondent no. 1.
The petitioners have preferred the present petition inter-alia with the prayer to set-aside the order dated 23.06.2021 passed by the Civil Judge (Senior Division), Gautam Budh Nagar in Original Suit No. 433 of 2021.
A preliminary objection has been raised by the counsel for the respondent that against the order impugned remedy is available to the petitioners to approach the appropriate forum under Order 43 (1) (r) of the Code of Civil Procedure.
It appears from perusal of the record that against the order dated 23.06.2021, a statutory remedy is available to the petitioners to file an appeal.
Since the Statutory remedy is available to the petitioners, the present petition is dismissed on the ground of availability of statutory alternative remedy.
