Sri Kaustubh Srivastava has filed vakalatnama on behalf of the applicant which is taken on record. He states that he has taken no objection from Sri Pawan Kumar earlier counsel for the applicant.
Heard Sri Kaustubh Srivastava, learned counsel for the applicant, Sri I.P. Srivastava, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is the husband of the deceased. On the date and time of incident, he was not present at the place of occurrence as he was out of India. He had come to India only on 19.6.2015. The deceased committed suicide for the reasons best known to her. Moreover, the mother of the deceased in her statement recorded during the course of investigation has not disclosed the participation of the applicant in the crime. The applicant is in jail since 13.11.2015, hence he may be released on bail.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that the applicant is the husband of the deceased. The trial is in progress.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Sandeep Gupta involved in Case Crime No. 768 of 2015 under sections 498-A, 304-B I.P.C. and 3/4 D.P. Act, police station Nichlaul, District Mahrajganj.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
