1.0 By way of present petition, the petitioners have prayed for quashing and setting aside the impugned judgement and order dated 30.12.2010 passed in Application No. 14 of 2010 by the Gujarat Primary Education Tribunal whereby the petitioners are directed to pay the subsistence allowance at the rate of 75% to the respondent No.1.
2.0 As a result of hearing and perusal of the record, I am of the view that interest of justice would be met by passing the following orders:
[a] The petitioner is directed to complete the inquiry proceedings against the respondent No.1 within a period of six months from today.
[b] Respondent No.1- Laljibhai P. Makwana will not seek any adjournment in the inquiry proceedings against him. If he seeks adjournment, he will not be paid subsistence allowance for the which he will seek adjournment i.e.for one week or 10 days or any other period he will not get any subsistence allowance. With the above observation, petition stands disposed of. Subject to above notice is discharged.
