By way of this petition, the petitioner has challenged the judgement and order dated 17.08.2011 passed by the Authority under M.W.Act, 1948 & Regional Labour Commissioner (Central) Ahmedabad, whereby the petitioner association has been imposed penalty. However, there are certain facts which were required but could not be reconsidered by the authority.
In that view of the matter, order at Annexure A is quashed and set aside. Matter is remanded back. The authority will examine the matter and the petitioner will also produce proof of overtime, for which they will produce electricity bill especially for Saturday and Sunday. It is clarified that, this Court has not expressed any opinion on merits. Petition stands disposed of accordingly.
