(Order of the Court was made by the Hon'ble Chief Justice) This writ petition is directed against the alleged failure of respondent No.2 to take a decision on the application of the petitioner for permission to hold a public meeting on 18th December 2017 on the northern side of Udumalpet-Palani Road and eastern side of Udumalpet Bus Stand.
2. Learned Government Pleader (i/c) submits that the land belongs to Udumalpet Municipality as per the petitioner's own averment in the affidavit in support of the writ petition. Unless no objection is obtained from the Commissioner, Udumalpet Municipality, the police authorities cannot consider the application for permission to hold the meeting.
3. From the documents annexed to the writ petition, it appears that on the same date i.e., 17.10.2017, applications were sent to respondent No.2 as also the Commissioner, Udumalpet Municipality.
4. The writ petition is disposed of by directing the Commissioner, Udumalpet Municipality to take a decision on the application of the petitioner in accordance with law within one week from the date of communication of this order. If the decision is in favour of the petitioner, the Inspector of Police concerned shall take a decision with regard to the application for permission on merits expeditiously, preferably within one week thereafter. No costs.
