JUDGMENT / ORDER

Hon'ble Prakash Krishna,J.
Sri S.P. Kesharwani, learned Addl. Chief Standing Counsel appearing for the department prays for and is allowed three weeks' time to file counter affidavit. The petitioner may file rejoinder affidavit on or before 7th May, 2012.
List on 7th May, 2012.
Learned counsel for the petitioner submits that notice has already been issued on 24th February, 2012 with regard to the period 01.04.2008 to 30.09.2008 for which the petitioner has applied for compounding under the scheme.
In view of the aforesaid, the assessment may be completed for the aforesaid period but the same shall not be given effect to without leave of the Court.
