Prayer in S.A.No.486 of 1999 : Second Appeal is filed under Section 100 of the Code of Civil Procedure against the judgment and decree in A.S.No.114 of 1989 on the file of Sub Court, Tiruvallur dated 28.07.1994 by confirming the judgment and decree passed in O.S.No.539 of 1981 on the file of the District Munsif Court, Ponneri dated 28.04.1987.
There are two second appeals, the appellant in both the second appeals is one and the same.
2. On 13.03.2017, when the matter was listed and called, there was no representation on behalf of the sole appellant. Therefore, the matter was directed to be listed under the caption for dismissal on 20.03.2017. On M.SUNDAR.J kkd 20.03.2017, there was no representation for the appellant in both the second appeals and hence the matter was again directed to be listed on 21.03.2017 under the caption for dismissal. Therefore, with an intention to give one more opportunity to the appellant in both the second appeals, the matter was posted today ( 21.03.2017) under the caption for dismissal.
3. Even today ( 21.03.2017), there is no representation for the appellant in both the second appeals.
4. Therefore, both the second appeals are dismissed for default/non-prosecution.
