Application seeking amendment is not being opposed by respondents. The amendment application is allowed.
Petitioner is permitted to carry out the necessary amendment in the writ petition during the course of the day.
Order on the writ petition:
Heard learned counsel for the petitioner, learned Standing Counsel for the State respondents and learned counsel for Nagar Nigam, Mthura.
Grievance of the petitioner is that he has applied for sanction of map of his land but the same has been refused on the ground that he is required to submit 'no objection certificate' from the Health Department.
Counsel appearing for the Nagar Nigam submits that application of the petitioner has not been rejected and he has been simply asked to submit particular document.
Counsel for the petitioner submits that the document sought by the Nagar Nigam is in possession of the petitioner and he would produce the same before the Assistant Commissioner.
Counsel for Nagar Nigam submits that if the petitioner produces such document, his application would be considered in accordance with law.
Without observing anything on merit, this petition is disposed of permitting the petitioner to submit the relevant document before the Nagar Nigam, Mathura and in turn it is expected from the concerned authority of the Nagar Nigam to pass appropriate orders in accordance with law expeditiously.
