This writ petition has been filed seeking the following relief:-
"(i) issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 (Tehsildar Sadar District Azamgarh) to decide revenue case no. T20131506014638 Sampati versus Rampati and others under Section 176 Z.A. Act early specific period preferably within one month"
The petitioner is aggrieved because his partition suit filed in the year 2013 has not been decided finally till date.
Perusal of the order sheet appended to the writ petition reveals that although written statement has been filed, issues have not been framed.
It therefore, follows that the parties are yet to adduce their evidence.
Under the circumstances, this writ petition is disposed of with the observation that the respondent no.2 i.e. Tehsildar, Tehsil Sadar District Azamgarh may endeavour to decide the partition suit expeditiously, preferably within a period of 12 months from the date of certified copy of this order is filed before him.
