Heard Sri S.K.Upadhyay, learned counsel for the petitioner, learned Standing Counsel appearing for the State-respondent no.2, Sri Neeraj Dube, learned counsel appearing for respondent no.3 and Sri Rakesh Kumar Mishra, learned counsel appearing for respondent no.1.
The petitioner is a co-tenure holder of gata no.1024 out of which her share of 140 meters of land has been utilized for construction of Highway by the National Highways Authority. The compensation etc. has also been determined but the same is not being paid on account of pendency of Writ C No. 24692 of 2018 (Raj Kali and another Vs. State of U.P. and others) before this Court. This has been informed to the petitioner under the Right to Information Act by information given on 15th September, 2018.
Learned counsel for the petitioner has annexed a copy of the judgment of this Court dated 10.12.2018 that the writ petition has been dismissed.
Since the only reason mentioned in the information given to the petitioner is the pendency of the writ petition, which has now been dismissed, the authorities may consider the claim of the petitioner and pass appropriate orders with regard to payment of compensation in accordance with law, as far as possible, within a period of three months from the date a certified copy of this order is presented before the authority concerned.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
