Heard learned counsel for the petitioners; learned Standing Counsel for respondent nos. 1 to 4; and Sri H.N. Singh for respondent No.5.
The submission of the learned counsel for the petitioners is that under the sterilization programme, the petitioners were sterilized and in lieu whereof, under certain Government Orders, the petitioners were put in possession of a plot of land that came to be pasture land over which no bhumidhari right could accrue and, therefore, the petitioners were evicted therefrom.
The prayer in this petition is that the respondents be commanded to consider the claim of the petitioners to provide compensation in lieu of their sterilization in the year 1992.
There is no document on record to indicate that the petitioners were allotted plots in lieu of sterilization. It appears from the submissions that revenue entries made on pasture land were corrected and, therefore, now the petitioners are seeking compensation for the serialization programme which they allegedly underwent in the year 1992-1993.
In our view, such a belated claim of the petitioners deserves to be rejected at the threshold as barred by laches.
The writ petition is, therefore, dismissed as barred by laches.
