1. The present Criminal Misc.Application u/s.482 of applicant herein – original accused to quash and set aside the impugned FIR being C.R.No.I-79 of 2010 registered with Jasdan Police Station.

Considering the fact that during the pendency of the present proceedings, the applicant has been charge- sheeted, at the outset, Mr.Ashish Dagli, learned advocate appearing on behalf of the applicant seeks permission to withdraw the present application with a liberty in favour of the applicant to submit an appropriate application for discharge before the concerned Magistrate.
3. Under the circumstances, the present application is dismissed as withdrawn with above liberty, without further entering into the merits of the case. As and when any such application for discharge is submitted by the applicant before the concerned Magistrate, the same shall be considered by the concerned Magistrate in accordance with law and on merits and without in any way being influenced by the present order. Rule is discharged. Ad-interim relief granted earlier, if any, stands vacated forthwith.
4. In view of the disposal of main Criminal Misc. Application No.2104 of 2011, no order in Criminal Misc.Application No.13881 of 2011 and the same is also dismissed.
