Heard Sri Pradeep Kumar Chaurasia, learned counsel for the petitioner and the learned standing Counsel.
The petitioner has sought for quashing the provisions of Section 43(5) of the Real Estate (Regulation and Development) Act, 2016 as being ultra vires.
Sri Waseem Masood, learned counsel appearing for respondent no. 4 has brought to our notice a decision of the Lucknow Bench of this Court dated 28.2.2020 in Misc. Bench No.5867/2020, whereby similar challenge was repelled.
Learned counsel for the petitioner is unable to controvert the above position.
The writ petition is dismissed as infructuous.
