The petitioner, in this writ petition, is seeking quashing of the order dated 10.07.2018 passed by the U.P. Real Estate Regulatory Authority, Ghaziabad as well as the recovery citation dated 31.03.2019 issued by the Tehsildar, Gautam Budh Nagar.
The order impugned in the writ petition is appealable under sub-section (5) of section 43 of the Real Estate (Regulation & Development) Act, 2016 (hereinafter referred to as 'the Act of 2016').
We, therefore, dismiss this writ petition with liberty to the petitioner to avail his remedy under section 43 of the Act of 2016.
