Sri Ajeet Kumar Srivastava, learned counsel for private respondent no.4 is not present though the matter has been taken up in the revised list.
Heard Sri Shibli Naseem, learned counsel for the petitioners, Sri Gaurav Pratap Singh, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
This writ petition has been filed by the petitioner with a prayer to quash the impugned FIR dated 2.9.2018, registered as case crime No.154 of 2018, under Sections 498A, 377 I.P.C., P.s. Kheta Sarai, District Jaunpur.
This matter being matrimonial in nature was referred to Mediation & Conciliation Centre of this Court vide order dated 11.10.2018.
Learned counsel for the petitioners submits that the mediation between the parties has failed. The report of the Mediation and Conciliation Centre dated 18.4.2019 is available on record.
From the perusal of the interim order dated 11.10.2018 passed by a Coordinate Bench of this Court it appears that this Court had stayed the arrest of the petitioners till submission of police report under Section 173 (2) Cr.P.C. and since the investigation has not been completed till date, we dispose of this writ petition with the direction that the petitioners shall not be arrested till submission of police report under Section 173 (2) Cr. P. C. The petitioners shall file a certified copy of this order within two weeks' from today before the SSP concerned, who shall look into the matter and ensure that the investigation in the above mentioned case is completed expeditiously preferably within six weeks from the date of production of certified copy of this order.
With the aforesaid direction, this petition is finally disposed of.
Learned AGA shall communicate this order to the concerned authorities concerned.
