Heard learned counsel for the appellant, learned AGA for the State and perused the record.
Appellant Sameer @ Pradeep Verma was convicted in Sessions Trial No. 564/2010 arising out of case crime no. 481/2009 under Section 302 IPC, P.S. Sahadatganj, District Lucknow.
It is submitted by the learned counsel for the appellant that the present case is of circumstantial evidence and only evidence against the appellant is of last seen. The appeal is not likely to be heard in near future.
Considering the facts and circumstances of the case, I find it a fit case for bail.
Let the appellant be released on bail on his furnishing two sureties and a personal bond in the like amount to the satisfaction of court concerned.
Realisation of fine shall also remain stayed.
