JUDGMENT / ORDER

Petitioner has approached this Court seeking for a direction to the 2nd respondent to accept the application for issuance of passport by correcting the wrong entry in the date of birth and to issue renewed passport. 2. According to the petitioner, his date of birth in Ext. P2 passport is shown as 1.4.1970 instead of 1.4.1974. Petitioner submits that the same was a mistake, which was realised only later. He has produced extract of Secondary School Leaving Certificate as Ext. P3.
3. Learned standing counsel has filed a statement inter alia stating that the Passport Officer did not consider the petitioner's application on account of the fact that a civil suit was pending seeking for correction of date of birth.
4. An affidavit is filed by the petitioner stating that the said suit, O.S. No. 364/2013 pending before the Munsiff's Court, Manjeri, was dismissed as not pressed on 4.2.2014.
5. Under these circumstances, I do not think that there is any impediment for the 2nd respondent to consider the application of the petitioner for correcting date of birth in the passport and for re-issuing/renewing the passport. Such position of law is covered by the judgment of this W.P(C) No. 4374 of 2014 -: 2 :-
Court in Swapna Siji v. Union of India, 2012 (4) KLT 419.
6. Under these circumstances, this writ petition is disposed of directing the 2nd respondent to consider the request of the petitioner for correcting the wrong entry in the date of birth and to re-issue/renew the passport based on Ext. P3 extract of SSLC Book.
