Heard learned counsel for the petitioners.
The petitioners are the defendants in Original Suit No. 1084 of 2019 instituted by respondent nos. 1 to 4. The petitioners being aggrieved by the exparte injunction order dated 28.05.2019 passed by Civil Judge (Senior Division), Moradabad have approached this Court under Article 227 of the Constitution of India.
Against the order impugned, the petitioners have statutory alternative remedy of appeal under Order 43 Rule 1 of C.P.C. Consequently, the writ petition is dismissed on the ground of alternative remedy.
However, it is open to the petitioners to avail remedy under the law during summer vacation.
