Heard learned counsel for the petitioners, Shri Shitala Prasad Dubey, learned Standing Counsel for the State respondents and Shri Manoj Kumar Yadav, learned counsel for Gaon Sabha.
The petitioners are before this Court with request to issue direction to the Sub Divisional Magistrate, Tehsil Shahganj, District Jaunpur to decide the Case no.197/2016 computerized no.T2016143658013519 filed on 12.07.2016 with regard to land Arazi no.442 area 0.243 hectare new number no.271 expeditiously.
Learned Standing Counsel and Shri Manoj Kumar Yadav, Advocate very fairly state that in case the aforesaid case is still pending, the same shall be considered and decided by the Authority concerned expeditiously.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Sub Divisional Magistrate, Tehsil Shahganj, District Jaunpur to expedite the hearing of the aforesaid case and conclude the same expeditiously, preferably within a period of one year from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs.250/- but certainly after according opportunity of hearing to all the stake holders in the matter.
