This petition for writ is preferred to have a direction for removal of encroachment from public utility land. The encroachment alleged is a public nuisance and for removal of the same, an efficacious remedy is available to the petitioner under Section 133 of the Code of Criminal Procedure, 1973.
This petition for writ hence, is disposed of by keeping the petitioner at liberty to approach the competent Executive Magistrate under Section 133 of the Code of Criminal Procedure, 1973.
