Petitioner has been placed under suspension vide order dated 13.2.2018 on the charge that though he had been transferred from Shamli to Aligarh but he has not joined even after expiry of 30 days. It is contended by the petitioner that he was seriously ill and was undergoing treatment. Medical reports in that regard have been brought on record. It is also stated that the petitioner has joined on 10.3.2018.
The order is also challenged on the ground that only a preliminary inquiry is directed to be held in the matter and no regular inquiry is contemplated, which was impermissible.
Learned Standing Counsel states that disciplinary inquiry would be concluded at the earliest, in accordance with law.
In the facts and circumstances of the case as the petitioner has already reported for joining, it would be appropriate to permit the respondents to conclude the disciplinary proceedings initiated against the petitioner, in accordance with law, at the earliest possible. The petition stands disposed of by providing as under:-
(i) Petitioner shall be reinstated in service and allowed to work at the transferred place, pursuant to his joining on 10.3.2018.
(ii) Disciplinary proceedings initiated against the petitioner would be concluded within a period of four months. Petitioner undertakes to cooperate in the inquiry.
