JUDGMENT / ORDER

1. Rule returnable on 05.11.2012.
2. This court had issued notice to the respondent on 15.06.2012. From the records, it appears that the respondent has been served on 18.06.2012. However, none appears for the respondent. The averments made in the petition, therefore, have not been rebutted. It appears that the respondent is trying to avoid this court. If the interim relief is not granted at this stage the petition shall become infructuous.
3. Hence, ad-interim relief in terms of para 20(B) is granted on following conditions:
The Managing Trustee of the petitioner Trust shall file an affidavit during the course of the day or by tomorrow stating therein that the amount received from the students pursuant to the order of this Court shall be deposited before this court within 15 days from the date of receipt of such amount from the admission committee of the State Government.
The students being admitted in the petitioner trust shall be informed that the admission shall be subject to the final result of the petition.
It shall be open to the respondent to approach this Court for modification/clarification of the order and/or vacating the ad-interim relief.
Direct service is permitted.
